1. BOOKING A HOLIDAY
A holiday booking is made between Zermatt Ski Chalets (‘ZSC’) GmbH and the signatory of your booking confirmation (‘you’), who must be 18 years of age. All correspondence should be addressed to Zermatt Ski Chalets, Haus Mera Peak, Unterer Wiestiweg 3, 3920 Zermatt Switzerland.
2. DEPOSITS AND CONFIRMATION
On completion of your booking form and receipt of the deposit, we will send you confirmation of your booking, the balance due and payment schedule. The contract then exists between you and ZSC and this contract in all circumstances is governed by these booking conditions.
3. BALANCE PAYMENT
Full payment of the balance as shown on your confirmation invoice is due 12 weeks prior to your arrival. If the payment is not received at this point, we reserve the right to cancel your booking and levy cancellation charges as detailed below.
4. PAYMENT METHODS
When due, deposit and balance payments can be made by: (a) direct bank transfer, (b) Visa or MasterCard, Visa and MasterCard payments are made online through Telekurs Secure Paygate Link and subject to a 2.20% surcharge.
5. AMENDMENTS BY YOU
All alterations must be confirmed in writing and will come into effect on the day they are received by ZSC. You hereby agree to indemnify ZSC for any reasonable expenses incurred in making an amendment.
6. AMENDMENTS BY ZSC
In the unlikely event that any alteration is made by ZSC, which is deemed to be significant by ZSC (for example, a change of booking date or a change in the standard of accommodation), gives you the right to cancel the holiday if you wish and receive a full refund of monies already paid.
In the exceptional circumstance that the property is sold and no longer available for rent, you will be notified as soon as possible and all monies paid will be refunded. ZSC shall use all reasonable endeavours to assist you in finding another property or another booking period to substitute the cancelled holiday.
ZSC shall not be liable for any refund should we or you be forced to cancel or change your holiday due to circumstances amounting to Force Majeure. Such circumstances shall include, but are not limited to, war or threat of war, riot, civil strife, terrorism, industrial disruption, natural disasters, fire, technical problems, adverse weather, governmental action, government travel restrictions due to health reasons (Covid Pandemic exemption is detailed below) and similar events beyond our control.
6.1 COVID PANDEMIC
Cancellation of booking due to COVID-19 Pandemic the following terms apply:
- If Zermatt or the Zermatt Ski Area was closed due to Covid we would offer a 90% credit for a booking in the next year.
- Once you have arrived at the property these terms do not apply.
7. CANCELLATION POLICY
All alterations should be made in writing and will come into effect on the day they are received. You hereby agree to indemnify Zermatt Ski Chalets GmbH on behalf of the Owner of the property for any reasonable expenses incurred in making an amendment.
Should you wish to cancel your booking for whatever reason, this should also be made in writing and charges will be levied as follows:
- Prior to 12 weeks before your arrival any deposit shall be forfeited.
- Within this period 100% of the booking shall be due and payable to Zermatt Ski Chalets GmbH.
- In the event Zermatt Ski Chalets resells the full period for the full booking price a 75% credit will be offered to the next season.
We strongly advise every client take out suitable holiday insurance for the duration of their stay, including cancellation insurance to limit your cancellation risk, medical insurance and third party liability insurance.
8. YOUR RESPONSIBILITIES
It is your responsibility to ensure that you and all members of your group have adequate medical, liability and travel insurance and also any visas required for entry to Switzerland and Italy. We would ask in our booking form for you to provide us with details of your insurance cover.
You comply with Swiss Federal and Kantonal Covid Policies and International Covid travel requirements.
Please provide us with any allergies suffered by you or members of your group.
No smoking is permitted inside any ZSC properties. No pets are allowed inside any ZSC properties without prior consent.
You will indemnify ZSC and the Owner of the property for all losses and/or damage arising from any act or default on your part or the part of any member of your party. ZSC reserves the right to terminate your holiday if we deem, your, or a member of your group’s behaviour as being antisocial and unacceptable. In this instance you shall have no right to a refund for your holiday or any expenses incurred due to the termination of your vacation.
Included in this contract is your guarantee of payment for chargeable services requested by any of your guests, before, during or after your holiday.
You accept that you ski and enjoy other winter sports at your own risk within the restrictions imposed by the resort or other authorities. We are not responsible for your actions and these restrictions.
9. OUR RESPONSIBILITIES
We are responsible for any injury or death, damage or loss of property, if proven to be by our direct negligence but not for any other accident, injury or death, loss or damage that might occur.
Neither ZSC or the Owner of the property can accept responsibility for guests missing flights under any circumstances.
10. INSURANCE
It is the condition of every booking that each member of your party is covered by personal holiday insurance, and that the policy covers you adequately for winter sports, third party risks and costs incurred from damage to property or adjacent properties during your stay caused by you or any member of your party, your employees or visitors to the property.
11. SKIING WITH ZSC
It is the responsibility of you and your group to judge the suitability of the terrain you and your guests ski. If you or any member of you party ski on terrain on the recommendation of or accompanied by a representative of ZSC, we will not be liable for any injuries, howsoever caused.
12. TRANSPORT
The airport transfer service and any resort taxi transfers offered or organised by ZSC during your stay is accepted at your own risk.
13. RULES AND SAFETY PRECAUTIONS
Safety: The Properties are private homes and not hotels. There are no legal notices for precaution as you may find in hotels. Zermatt Ski Chalets GmbH and the Owner will not be liable for any accidents / injuries to you, the Occupants or your guests while staying at the Property.
Children: ZSC will endeavour to inform you of the suitability of the Property for children. However, please note that the Property may not have the same levels of safety measures that you may have in your home and the supervision of your children is your sole responsibility. In addition, our staff will not be held responsible for any children left unattended within the Property.
Balconies: It is strictly forbidden to climb on the parapets of the balconies of the chalet. Children may not be left unattended on the balconies of the chalet under any circumstances. ZSC and the owner decline any and all liabilities for any accidents that might occur due to negligent attendance or undue use of balconies.
The Property may contain a list pertaining to Rules and Security Precautions concerning the use of the Property or its facilities. Please read these Rules and Safety Precautions carefully if they are provided since they are an integral part of this agreement. You, the other Occupants and your guests shall strictly adhere to these Rules and Safety Precautions.
Wellness Area, Swimming Pool etc
General: At all times, you and your guests are to consider your own safety and the safety of others when using the wellness area. Use of the wellness area is at your and your guests’ own risk. You and your guests are to comply with the Rules and Security Precautions pertaining to the wellness area as communicated to you by the staff of ZSC and made available in the Property. Facilities are to be used for the designed purpose and in compliance with the instructions given by the staff of ZSC. Without prejudice to the generality of the above, the following things are strictly prohibited in the wellness area:
- (i) running;
- (ii) diving or jumping into the swimming pool or Jacuzzi;
- (iii) drinking of any alcohol or using the wellness area when under the influence of alcohol or drugs
- (iv) leaving children unsupervised in the wellness area.
Children: The direct, visual and active supervision of children present in the wellness area by an adult is essential and under your sole responsibility. The swimming pool, Jacuzzi etc located in the Property do not comprise an alarm system, safety nets or other safety measures designed to prevent the risk of drowning. To ensure the safety of children, the following precautions must be taken, in particular:
- (i) never leave young children alone near the swimming pool or Jacuzzi;
- (ii) never leave a child alone in the water, even if they know to swim, or in a Hamman, steam room, sauna etc. They must always be under the supervision of an adult capable of saving them in the event of an accident;
- (iii) never leave toys or other items floating on the water; they may encourage children to approach the water; and
- (iv) always fit inflatable armbands of floating costumes on young children.
Please note the swimming pools in ZSC properties may be shallower than 1.35m and there are no lifeguards on duty at any of the ZSC properties and as a private facility, the safety equipment may be less than you are used to. Sometimes cleaning of the swimming pools and hot tubs will be necessary, we will try do this at appropriate times in order to minimise disruption, but in some cases this may be unavoidable.
Excessive use of hot tubs or Jacuzzis can cause skin irritations which ZSC cannot be responsible for.
If you fail to comply with Rules and Security Precautions set out in these Booking Documents, communicated to you by the staff of ZSC and/or made available in the Property, the staff of ZSC shall be entitled to prohibit the use of the wellness area for the duration of your stay.
14. PROBLEMS
If you are ever unhappy with any aspect of your holiday, you must address your complaint immediately to the ZSC resort manager. In the unlikely event that your problem cannot be resolved locally, you must inform ZSC in writing or by email of your complaint within 30 days of your return so that any rights to compensation can be examined.
These terms and conditions are to be construed, and any dispute between the parties determined, under the laws of Switzerland.
All disputes arising out of or in connection with this Booking Document shall be submitted to mediation in accordance with the Mediation Rules of the Swiss Chamber of Commercial Mediation.
If no settlement can be reached by mediation, the dispute shall be finally settled by the courts of the Kanton of Wallis in Switzerland.
15. DAMAGE DEPOSIT
Guests will be asked to provide a damage deposit several days prior to arrival in resort. An amount is blocked, but not charged, on a Visa, Mastercard or American Express Card and this is then released on departure as long as there is no damage to the property and it is left in a clean and reasonable state and all rubbish has been removed. If rubbish has not been removed and the property is in an unreasonable state of cleanliness additional cleaning fees may be charged.
16. GENERAL
Headings within these booking conditions are for reference purposes only and all images are intended to give a general impression only. These standard terms and conditions and the terms set out in the Chalet Booking Form together constitute a contract and the entire agreement between you and ZSC and shall be subject to and governed by Swiss law. To the best of our knowledge all details on our website site were accurate on 1st June 2022.
These Zermatt Ski Chalets standard terms and conditions shall apply to all ZSC bookings unless otherwise expressly agreed for in writing with ZSC.
